Transport Malta has issued Merchant Shipping Notice 188 for Shipowners, Ship Operators, Managers, Masters, Owners’ Representatives and Recognised Organisations.
The Directorate draws everyone’s attention to the FuelEU Maritime Regulation (EU) 2023/1805, which pertains to ships larger than 5000 GT that are used for commercial passenger or cargo transportation whether they arrive at, remain at or depart from EU ports. The Regulation establishes standards for the yearly average GHG intensity of the energy that ships utilise.
Companies must submit a FuelEU Monitoring Plan to an accredited verifier by August 31, 2024, for each ship they operate. This plan must include the method selected from those listed in Annex I of the Regulation for tracking and reporting the quantity, kind, and emission factor of energy used by ships as well as other pertinent data.

Companies must begin tracking and documenting the necessary information for every ship they operate on a yearly basis as of January 1, 2025. This information includes the quantity of fuel used for each type of ship as well as the emission factors that account for all relevant greenhouse gases. Companies are required to submit a ship-specific FuelEU report with all pertinent data for the reporting period to the verifier by January 31st of the verification period.
The ship in question will receive a FuelEU Document of Compliance from the verifier by June 30, 2026, and for each year after that, if there is no GHG intensity compliance deficit or non-compliant port calls. Ships should possess the FuelEU Document of Compliance as proof that they have complied with the regulation. If a ship has a compliance deficit, it will be required to pay a FuelEU penalty, which will be determined by the verifier using the calculation in the Regulation. The FuelEU database will contain the relevant information on the Regulation.
Beginning on January 1, 2030, all passenger and container ships covered by the Regulation that are berthed in a Ten-T port for longer than two hours must utilise zero-emission technology or the Onshore Power Supply (OPS). By January 1, 2035, this requirement will also apply to all ports in the EU and EEA where onshore power is accessible.
The Merchant Shipping Directorate advises all concerned to ensure compliance with the provisions of
this Regulation.
